Thank you for your request for information about the following:

Request

‘On 31st March 2025, Karin Smyth MP issued a written statement (UIN HCWS566) in Parliament detailing progress on dealing with the McCloud remedy. That statement included numbers of cases still to be progressed and revised timescales. My request concerns the 14,376 cases classed as ‘Retired by 1/10/23 – formerly unprotected and both legacy and reform benefits in payment.’ A revised deadline of 1st October 2025 was detailed in this statement for this group giving an extension of 6 months on top of the original 18 months that had been set previously.

Of the 14,376 cases above I am requesting the following figures

How many of the 14,376 cases were resolved in the period from 1st April 2025 to 30th September 2025

How many of the 14,376 cases were resolved in the period from 1st October 2025 to 28th February 2026

How many of the 14,376 cases remain unresolved as at 1st March 2026.’

[On 17 March 2026 you clarified your request as follows]

‘I am happy for you to provide number based on RSS sent out to members.'

The NHS Business Services Authority (NHSBSA) received your request on 3 March 2026, with clarification received on 17 March 2026.

We have handled your request under the Freedom of Information Act 2000 (FOIA).

Our response

Please note that the previously reported total of 14,376 members (as of March 2025) has been revised to 13,648. There has been some realignment of cohort allocation based on member status. Cohorts are dependent on member status which may change, for example when a member retires or we are advised they are deceased.

For reporting purposes, “resolved” refers to cases where the member has been sent an RSS as clarified by the requester.
