Thank you for your request for information about the following:

Request

You asked us:

‘As a matter of interest is there a figure of how many cases are being assessed at the moment. I wonder whether the other 6 people who had the Sanofi jab at Chelsea Hospital on the day I attended have made a VDP application..

The NHS Business Services Authority (NHSBSA) received your request on 30 December 2024.

We have handled your request under the Freedom of Information Act (FOIA) 2000.

Our response

I can confirm that the NHSBSA holds some of the information you have requested.

Question 1 - is there a figure of how many cases are being assessed at the moment.

Under Section 21 of the FOIA, we are not required to provide information in response to a request if it is already reasonably accessible to you.

The NHSBSA actively publishes information on claims made to the Vaccine Damage Payment Scheme (VDPS) on the Open Data Portal for both COVID-19 and non-COVID-19 claims.

You can find the Open Data Portal at:
• COVID-19 claims: https://opendata.nhsbsa.net/dataset/vdps-covid-19
• non-COVID-19 claims: https://opendata.nhsbsa.net/dataset/vdps-non-covid-19

To protect confidentiality, cells in the data may be intentionally left blank where changes in comparison to an earlier release equal fewer than five.

Please see the following link to view the section 21 in full: https://www.legislation.gov.uk/ukpga/2000/36/section/21

Question 2 - I wonder whether the other 6 people who had the Sanofi jab at Chelsea Hospital on the day I attended have made a VDP application.

Following a search of our paper and electronic records, I have established that we are unable to confirm whether this information is held by the NHSBSA. This is because the NHSBSA does not have the details of the six people you are referring to, to establish if they have made VDPS claims.

However, it may also be helpful to explain that if the information was held, the NHSBSA would not be able to provide this information as it would be considered exemption under section 40(2) and 3(A)(a) of the FOIA. This is because it is information relating to another identifiable person.
