Thank you for your request for information about the following:

Request

‘1 a statement of the eligibility for the McCloud remedy which you made available for people in or previously in the NHS pension schemes? In plain English please not technical language - something like 'if you were employed between x and y dates and continued employment to z date'

2 the dates and volumes of notification of eligibility communications you sent to the eligible people by method [eg, letter, email] and dates of batches if you batched them

3 the number of people who replied to each batch in whatever way, split my method of contact, eg paper, email, phone, and batch

4 the number of people who have told you they didn't receive a letter in any of the batches you sent, by batch’

We have handled your request under the Freedom of Information Act 2000 (FOIA).

Our response

Question 1

We have considered this request under the Freedom of Information Act 2000 (FOIA 2000) and are issuing a refusal notice under section 17 of the FOIA.

The NHSBSA does hold the requested information; however, we consider that this information is exempt from disclosure under section 21 of FOIA. This provides an exemption from the duty to disclose information where this is reasonable accessible to an applicant by other means.

I am writing to advise you that following a search of our paper and electronic records, I have established that the information you requested is not held by the NHSBSA.

The NHSBSA have not written to members to inform them of their McCloud eligibility.
