Request
I request the total costs to the NHSBSA (including all legal and expert witness costs) spent defending a vaccine damage payment scheme appeal including legal costs incurred specifically limited to cases where the applicant has been successful in securing a Vaccine Damage Payment.
The NHS Business Services Authority (NHSBSA) received your request on 20 November 2024.
We have handled your request under the Freedom of Information Act (FOIA) 2000.
Our response
I can confirm that the NHSBSA holds the information you have requested.
All data is as of 1 December 2024 and relates to all eligible vaccines: https://www.gov.uk/vaccine-damage-payment/eligibility
All data relates to appeals made to HM Courts and Tribunals Services (HMCTS) received since we took over administration of the Vaccine Damage Payment Scheme (VDPS) from the Department for Work and Pensions (DWP) on 1 November 2021 and any appeals in progress that they transferred to us. The data does not therefore reflect any appeals heard prior to the transfer of the VDPS from DWP to us. The total spend from 1 November 2021 to 1 December 2024 for fees relating to appeals heard at a tribunal where the applicant has been successful in securing a Vaccine Damage Payment is £0. This is because there have been no appeals where the decision about a Vaccine Damage Payment has been changed by HMCTS.
