Request
The information I am looking for is, of the claimants who have appealed against having their claim rejected, how many have a successful appeal, as a percentage.
The NHS Business Services Authority (NHSBSA) received your request on 17 October 2024.
We have handled your request under the Freedom of Information Act (FOIA) 2000.
Our response
I can confirm that the NHSBSA holds the information you have requested.
All data is as of 30 September 2024 and relates to all eligible vaccines:
https://www.gov.uk/vaccine-damage-payment/eligibility
All data relates to appeals received since we took over administration of the Vaccine Damage Payment Scheme (VDPS) from the Department for Work and Pensions (DWP) on 1 November 2021 and any appeals in progress that they transferred to us. The data does not therefore reflect any appeals heard by a tribunal prior to the transfer of the VDPS from DWP to us.
51 claimants have submitted an appeal to HM Courts and Tribunals Service:
https://www.gov.uk/vaccine-damage-payment/if-you-disagree-with-a-decision
Of the 51 appeals received, 13 have been heard by a tribunal. The number of successful appeals as a percentage is 0%.
