Thank you for your request for information about the following:

I would like to request information regarding the Mcloud judgement and the percentage of early retired employees who have chosen to revert their 2015 benefits back to the 1995 section specifically. To be clear it is only early retired employees not currently contributing to the scheme. Those that had automatically been moved to the 2015 section of the scheme, without the choice due to their age. Therefore the Mcloud judgement claims were moved and the result of age discrimination .Therefore the percentage number of retired employees who have chosen to have their 2015 pension they are receiving reverted back to the 1995 who have been contacted by NHSBSA and the number who like myself have still not been contacted. Lastly the criteria for prioritising contacting them. The timescale has been moved many times. This request is only for early retired employees please and not retired at normal pensionable age or still contributing.

Your request was received on 31 May 2024 and I am dealing with it under the terms of the Freedom of Information Act 2000.

Response

The NHSBSA does not currently hold the data to provide an answer to your request.

Due to the complex nature of the calculations involved to ensure that all members are given complete and accurate information with which to make a fully informed choice, NHS Pensions have not yet contacted any people who took early retirement regarding their Immediate Choice. We are working hard to get the information required to members as soon as we are able.
