I refer to your request under the Freedom of Information Act, which I received on 25 March 2024 for information about the following:
Are you able to confirm if the NHSBSA holds data on the number of decisions made regarding Permanent Injury Benefit [PIB] that were overturned via ombudsman or tribunal decisions?
Response
I am writing to advise you that following a search of our paper and electronic records, I have established that the information you requested is not held by the NHS Business Services Authority.
The Pensions Ombudsman cannot overturn a Permanent Injury Benefit (PIB) decision. The Ombudsman is responsible for ensuring that cases have been considered correctly in accordance with the NHS Injury Benefits Regulations. If they feel it has not, then they would ask us to reconsider it afresh.
Tribunals do not form part of the NHSBSA’s Complaints procedure. If a claimant remains dissatisfied with the outcome of a claim, then they would go to the Pensions Ombudsman. Tribunals tend to be between an employee and employer.
