I would like to submit an FoI request please.
From a previous FoI response( FOI-02555) in January 2025, I understand 137,665 members affected by the Public Service Pensions Remedy (McCloud), had their pensionable service between 1 April 2015 and 31 March 2022 moved from the 2015 Scheme to the 1995/2008 Scheme and need a Remedial Pension Savings Statement (RPSS). From the same FoI response I see that 56,773 members [equivalent to approx. 41%] had an RPSS sent to them by 31 January 2025.
For the most recent date for which you have records for (e.g. end September or end October 2025 once this is closed?) how many of these 137,665 NHS staff have been sent their RPSS statement?
How many of the members identified in Question (a) also have a 2023/24 Annual Allowance record on file?
When is the estimated latest date for the RPSS statements to be delivered to the members who are still awaiting them?
How many days on average is it taking from sending an RPSS statement to sending the 2023/24 Annual Allowance statement? As this may be too onerous – then this could be estimated by just looking at the last twenty-five individuals who received 2023/24 Annual Allowance statements sent to those who also received an RPSS statement and calculating the number of days on average between the receipt of the RPSS and the Annual Allowance Statement just for those 25?
How many claims have been received from the NHS Cost Claim Back Scheme for individuals with membership in the period from 1 April 2015 to 31 March 2022, which is subject to the McCloud remedy?
Of the answer to (e) - how many claims have been paid out, and secondly, to what total value under the NHS Cost Claim Back Scheme?
Is there an intention to extend the deadlines for cost claim pay back, and Scheme Pays amendments, to those people who continue to await their RPSS statement and 2022/23 Annual Allowance Statements – for example if they have still not received them by end January 2026 or end January 2027 etc.?
How many members have decided to reinstate opted-out remedy period membership into the 1995/2008 scheme?
If known, what percentage is the answer in (h) of the total number of members who opted out during their remedy period membership?
How many McCloud Self-identify Forms have been received?
How many members of the above in (i) who submitted McCloud Self-identify Forms are still awaiting their RPSS statements more than 4 months after receipt of the Forms?

Please read the below notes to ensure correct understanding of the data.
With respect to volumes, the initial population referenced in the earlier FOI ( FOI-02555) was based on estimated data at that time. The actual population, in scope of requirement of an RPSS, as of 24 November 2025 is set out in the table below:

Question A:- For the most recent date for which you have records for (e.g. end September or end October 2025 once this is closed?) how many of these 137,665 NHS staff have been sent their RPSS statement?
As of 23 December 2025, out of 137,665, we have sent 118,595 RPSS statements.
Question B:- How many of the members identified in Question (a) also have a 2023/24 Annual Allowance record on file?
1,488 of the 2,737 PSS members have been sent an RPSS
Question C:- When is the estimated latest date for the RPSS statements to be delivered to the members who are still awaiting them?
This is currently being progressed with internal teams, and an estimated completion date is not available at this stage.
Question D:- How many days on average is it taking from sending an RPSS statement to sending the 2023/24 Annual Allowance statement? As this may be too onerous – then this could be estimated by just looking at the last twenty-five individuals who received 2023/24 Annual Allowance statements sent to those who also received an RPSS statement and calculating the number of days on average between the receipt of the RPSS and the Annual Allowance Statement just for those 25?
It has taken an average of 101.98 days for those that have been sent to date.
Question E:- How many claims have been received from the NHS Cost Claim Back Scheme for individuals with membership in the period from 1 April 2015 to 31 March 2022, which is subject to the McCloud remedy?
There are 8,849 unique members with an application submitted for a McCloud cost claim.
Question F:- Of the answer to (e) - how many claims have been paid out, and secondly, to what total value under the NHS Cost Claim Back Scheme?
To date, we have accepted and paid 8,423 claims, with total payments under Cost Claim Back, including interest, amounting to £7,569,712.40.
Question G:- Is there an intention to extend the deadlines for cost claim pay back, and Scheme Pays amendments, to those people who continue to await their RPSS statement and 2022/23 Annual Allowance Statements – for example if they have still not received them by end January 2026 or end January 2027 etc.?
Members have 12 months from the date they receive their RPSS to submit a claim; this requirement remains unchanged. The Scheme Pays deadline for both mandatory and voluntary elections has already been extended to 2026.
Question H:- How many members have decided to reinstate opted-out remedy period membership into the 1995/2008 scheme?
There are currently 323 unique members who have chosen to reinstate their opted‑out remedy period membership into the 1995/2008 scheme.
Question I:- If known, what percentage is the answer in (h) of the total number of members who opted out during their remedy period membership?
This information is not held by the NHSBSA as we cannot determine whether a member opted out and/or is eligible for Service Buy Back. For this reason, a targeted mail merge exercise could not be carried out, and instead, the application form was made available on the website for members to apply.
Question J:- How many McCloud Self-identify Forms have been received?
A total of 1,381 members have submitted a McCloud Self-identify Form.
Question K:- How many members of the above in (i) who submitted McCloud Self-identify Forms are still awaiting their RPSS statements more than 4 months after receipt of the Forms?
A total of 589 members have not received an RPSS more than four months after submitting their forms.
