Under the Freedom of Information Act, I would like to request the following information:
The number of persons in receipt of an NHS pension/members of NHS Pensions whose pensions have been withheld or reduced on the basis of the McCloud judgement (2018)
The amount of money (in UKP )NHS Pensions has withheld from pensioners on the basis of the McCloud judgement (2018).
A breakdown of bonusses received by senior managers and executive directors at NHS Pensions and the criteria on which these were awarded since the McCloud judgement (2018)
The NHS Business Services Authority (NHSBSA) received your request on 8 October 2025
On 24 October 2025, you clarified that:
Oxford English Dictionary define "withheld" as "to keep back", "to keep in ones possession" and "reduced" as "to bring down or diminish". In other words any pension payments NHS Pensions reduced or kept back on the basis of the McCloud judgement (2018),

Our response
Question 1: The number of persons in receipt of an NHS pension/members of NHS Pensions whose pensions have been withheld or reduced on the basis of the McCloud judgement (2018)
The requested information is not held by the NHSBSA.
To confirm, no pensions have been withheld. The McCloud judgement enables members to choose an alternative benefit option now available to them.
Question 2: The amount of money (in UKP) NHS Pensions has withheld from pensioners on the basis of the McCloud judgement (2018).
The requested information is not held by the NHSBSA.
No money has been withheld in the common meaning of the word
Question 3: A breakdown of bonusses received by senior managers and executive directors at NHS Pensions and the criteria on which these were awarded since the McCloud judgement (2018)
The requested information is not held by the NHSBSA.
As a public sector NHS employer bonus payments do not form part of the agreed salary structure. Any payments made are part of the agreed NHS pay framework.
