The NHS Pensions website notes the deadline of 01/07/2025 in relation to the McCloud Remedy arrangements for the following 2 categories:
- Retired by 1 October 2023 who were formerly unprotected and only legacy benefits in payment: 5012 individuals
- Retired by 1 October 2023 who were formerly taper protected and only legacy benefits in payment: 25827 individuals
Please advise how many of the individuals in each category above have been sent the correspondence they need ahead of 1 July deadline, to allow them to make a decision about their pension in relation to the McCloud remedy.

I can confirm that the NHSBSA holds the information you have requested.
Data as of 2 July 2025, the volumes of members in the below two cohorts who have been sent a Remediable Service Statement (RSS) is as follows:
- Cohort one: 999 members
- Cohort two: 329 members
The McCloud remedy is complex and requires activity and calculations for which there is no precedent. Because of this, the timescale of forecasted completion rates announced by the minister in late March 2025, was based on assumptions about key milestones, capacity and resource, decisions, and approvals. As we have progressed, the scope of the work to provide individual statements has significantly exceeded initial forecasts. This, therefore, means it has become unavoidable that the timetable will need to change.
The challenges of McCloud delivery are not unique to NHS Pensions, with all public sector schemes reporting risks to timescales. But, with almost 4m members, the scale of the NHS Pension Scheme adds a layer of complexity. As we navigate the unprecedented territory of delivering McCloud, NHS Pensions continues to be open and transparent with our Scheme members and with Department of Health and Social Care (DHSC).
We appreciate that this delay will be frustrating for our members and we apologise. We are working closely with The Pensions Regulator (TPR) and with DHSC to agree an updated timetable as quickly as possible.
We will provide regular updates to Scheme members as timelines are confirmed. We will also continue to update the McCloud delivery timetable as much as possible on our website at:

In the meantime, we continue to issue RSS to affected members and we are actively processing decision forms that are returned to us. As of 29 July 2025, we have issued 2,048 RSS. Of the 994 returned decisions to date, we have enacted 893 (89.84%).
